NLG Charlotte Waiver Finale

IN CONSIDERATION of being permitted to participate in any way at Next Level 7on7 Football (NLG) activity (“Activity” or “Activities”) I

for myself for personal representatives, assigns, heirs, and next of kin now declare:

1. ACKNOWLEDGE, agree, and state that I understand the nature of Next Level 7on7 Football Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
2. FULLY UNDERSTA AND ACKNOWLEDGE THAT: (a) NEXT LEVEL 7ON7 FOOTBALL ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I might incur as a result of my participation or that of the minor in the Activity; (d) the FACILITY (as defined below) and the equipment and all other items contained therein are provided “as is” and without any warranty of any kind; and (e) that I have adequate health insurance to cover any injury that the I may sustain during or as a result of participating in the Activities.
3. As additional consideration for training and/or 7on7 at Next Level 7on7 Football Facilities, I agree that my attendance and/or performance in the Activities MAY BE PHOTOGRAPHED, VIDEOED, FILMED, AND/OR TAPED AND USED BY NEXT LEVEL 7on7 FOOTBALL FOR ANY LAWFUL PURPOSE, including marketing and entertainment such as reality television and/or documentary use, and I authorize the use of my image in connection therewith. Additionally, I WAIVE THE RIGHT OR ENTITLEMENT (IF ANY) TO ANY COMPENSATION FOR THE USE OF MY IMAGE THROUGH ANY OF THESE MEANS, EVEN IF I DISCONTINUE MY TRAINING AT NEXT LEVEL 7on7 FOOTBALL. I also acknowledge that I would like to receive correspondence from Next Level 7on7 Football via telephone, mail, text message and email.
4. HEREBY RELEASE, DISCHARGE, AND AGREE AND PROMISE NOT TO SUE NEXT LEVEL 7on7 FOOTBALL, its proprietors, including but not limited to, Marcus Hammond, Preston Brown, and Brandon Bather, as well as their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place (the “Facilities”), including, but limited to 4100 Weddington Rd Concord, NC 28027, City of Charlotte; NFA 7v7 and any of its affiliates etc, and any other facility from which Next Level 7on7 Football Activities will take place (each considered one of the “RELEASEES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT THAT ARE CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT MEDICAL ASSISTANCE RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY. I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEBLE THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. I FURTHER ACKNOWLEDGE THAT I HAVE EITHER REGISTERED WITH AAU AND THAT MY MEMBERSHIP NUMBER FOR SUCH REGISTRATION IS LISTED BELOW, OR THAT I DECIDED NOT TO REGISTER AND THAT I KNOWINGLY AGREE TO ASSUME THE RISK OF ANY INJURY AND LIABILITY FOR ANY MEDICAL EXPENSES AS A RESULT OF INJURY. IN SIGNING THIS DOCUMENT, I HEREBY ACKNOWLEDGES AND AGREES THAT THAT I HAVE READ THIS DOCUMENT IN ITS ENTIRETY, UNDERSTAND ITS TERMS AND HEREBY FREELY AND VOLUNTARILY SIGN THIS DOCUMENT AS MY OWN FREE WILL AND ACT. IF THIS DOCUMENT IS NOT SIGNED BY A PARENT OR GUARDIAN, THEN I HEREBY REPRESENT TO YOU THAT I AM AT LEAST 18 YEARS OF AGE AND OF SOUND MIND. THIS DOCUMENT IS GOVERNED BY THE LAWS OF THE STATE OF NEW JERSEY WITHOUT GIVING EFFECT TO ITS CONFLICTS OF LAW PROVISIONS

AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF NEXT LEVEL 7on7 FOOTBALL ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES, AND I BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, AGREE AND PROMISE NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT MEDICAL ASSISTANCE OR RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.

In an effort to limit players and spectators to COVID risks, the following restrictions will be in place:

• Each person will have their temperature taken upon entering the park. Anyone with a spiked temperature will be denied entry.
• All players and spectators will be required to wear a mask / face covering at all times other than actively participating in physical activities.
• Upon completion of your event, you are required to leave the facility immediately upon the event's conclusion
